“Consent Management – Consent to Establish and Consent to Operate”

 

 

About the Service:

Consent Management refers to the process by which industries, commercial units, and infrastructure projects obtain statutory approvals from the West Bengal Pollution Control Board (WBPCB) to ensure that their operations do not harm the environment.

It includes two critical stages:

• Consent to Establish (CTE) – prior approval before setting up the unit.
• Consent to Operate (CTO) – approval after installation and before starting operations.

 

What is it?

The Consent to Establish (CTE) is the initial clearance that allows an entrepreneur to construct, install, or expand an industrial project after evaluating its environmental implications.

 

Once the establishment phase is complete and the unit is ready to function, the entrepreneur must obtain Consent to Operate (CTO). This consent certifies that the industry meets all environmental standards relating to emissions, effluents, and waste management.

 

Together, they form the “Consent Management” system, ensuring industries operate responsibly and in line with the state’s environmental policies.

 

Who Needs It?

All industries, commercial establishments, healthcare facilities and projects with potential for pollution whether new or expanding, must obtain the relevant consent(s) from WBPCB.

Even small and medium enterprises fall under this requirement, depending on their category of environmental impact.

 

Where to Apply?

As indicated by the concerned Board (WBPCB) in its portal.

 

Purpose:

The main purpose of obtaining CTE and CTO is to:

• Ensure industrial development aligns with environmental sustainability.
• Prevent air, water, and soil pollution.
• Promote responsible waste management practices.
• Facilitate lawful operation and avoid penalties or closure notices.
• Build public trust by demonstrating compliance with environmental norms.

Category of Industries:

WBPCB classifies industries into five categories based on their pollution potential as per Central Pollution Control Board (CPCB) guidelines:

 

1. i) Red Category:            Pollution potential high
2. ii) Orange category: Pollution potential moderate

iii) Green Category:             Pollution potential low.

 

1. iv) White Category: Pollution potential negligible
2. v) Exempted category: Exempted from taking any consent

 

1. a) Red, Orange, and Green category: must obtain both CTE and CTO.
2. b) White Category – No necessity of obtaining consent and an intimation to WBPCB is sufficient. White category is permitted in any area in West Bengal subject to site clearance by local authority.
3. c) Exempted category: Need not apply for either ‘Consent to Establish’ or ‘Consent to Operate’ from the Board. Exempted category is permitted in any area in West Bengal subject to site clearance by local authority.
